Welcome to Rallypoint Bar & Arcade Country Club & Lounge. Golf is fun. Golf indoors, with real clubs and real balls flying at real speeds, is also real. Before you tee off, we need you to read and agree to the terms below. It protects you, it protects us, and it keeps everyone swinging safely.

The short version: Clubs are swung fast. Balls move faster. Accidents can happen. By booking a bay and stepping into the Country Club & Lounge, you're agreeing that you understand the risks, you'll follow the house rules, and you won't hold Rallypoint responsible for injuries or damages that come with the territory.

Now the long version.

1. Assumption of Risk

Golf involves real physical activity with real consequences. Clubs and balls routinely travel over 100 mph. Balls can ricochet off screens, mats, and surrounding surfaces. Walking near someone mid-swing is a bad idea and can result in serious injury or death. By using our facility, you acknowledge and accept these risks on behalf of yourself and anyone in your group.

2. Release of Liability

You, your heirs, and anyone claiming on your behalf agree to release, discharge, and hold harmless Rallypoint Bar & Arcade LLC and Rallypoint Country Club & Lounge (together with its owners, managers, employees, contractors, agents, and affiliates — collectively, the "Released Parties") from any and all claims, damages, losses, or expenses (including attorneys' fees) arising out of or related to your use of the premises, simulators, equipment, or participation in any activity on-site. This release applies to claims caused by negligence, with the exception of gross negligence or willful misconduct by the Released Parties.

3. Indemnification

You agree to indemnify and defend the Released Parties against any claims brought by third parties arising from your actions (or the actions of anyone in your group) while on the premises.

4. Medical Fitness & Personal Responsibility

You confirm that you are physically able to participate safely in indoor golf and have not been advised otherwise by a medical professional. You assume full responsibility for any aggravation of pre-existing conditions. You are responsible for your own medical expenses in the event of injury.

5. Damage to Property or Equipment

You're responsible for any damage to Rallypoint's property, simulators, impact screens, mats, clubs, launch monitors, electronics, furniture, or facility caused by reckless, careless, negligent, or intentional actions by you or anyone in your group. That includes but isn't limited to: swinging outside the designated hitting area, improper use of equipment, use of dirty or marked golf balls, misuse of personal clubs, or food and drink spills inside the simulator bays.

Examples of chargeable damage include:

Broken Club Shafts

Usually caused by excessive ground impact ("mat-and-fat" shots) or striking the simulator frame or enclosure.
Damage Fee: $50 per club

Impact Screen Damage

Caused by using dirty clubs, marked/scuffed golf balls, or improper simulator use that damages, stains, tears, or otherwise compromises the impact screen.
Damage Fee: Minimum $250, up to full replacement cost if the screen is rendered unusable.

Structural or Equipment Damage

Includes dents, holes, cracks, or damage to launch monitors, projector systems, televisions, simulator frames, turf, computers, sensors, or other electronic equipment caused by negligent or reckless behavior.
Damage Fee: Assessed based on repair or replacement costs.

Common Sense Policy

Our equipment and simulator bays are inspected before and after every session. We understand that normal wear and tear happens and that reasonable accidents may occur during regular gameplay. Normal wear and tear is our responsibility.

However, guests are financially responsible for damage caused by negligent, reckless, unsafe, or intentionally improper behavior while using the facility or equipment. Please use common sense, be aware of your surroundings, and respect the equipment so everyone can safely enjoy the experience.

6. House Rules (Non-Negotiable)

To keep everyone safe and having fun:

• Only the active golfer is allowed in the hitting area. Everyone else stays clear.

• Clean, non-marking shoes are required on the mats.

• Only clean clubs and clean, unmarked golf balls may be used in simulator bays.

• No swinging clubs outside the bay. Ever.

• Food and drinks stay at the lounge seating, not near the simulator or computer.

• No more than 4 golfers per bay.

• Minors (under 18) must be supervised by a non-golfing adult at all times.

• Staff reserves the right to end your session without refund if house rules are ignored or if behavior endangers guests, staff, or equipment.

7. Deposit & Cancellation Policy

A $25 per hour nonrefundable deposit is required to reserve a bay. Deposits are nonrefundable for cancellations, no-shows, or late arrivals that can't be accommodated. Bookings may be rescheduled up to 24 hours in advance, subject to availability. The remaining balance is due in full at check-in.

8. Parent or Guardian Consent

If you're signing on behalf of a minor, you represent that you are the parent, legal guardian, or authorized custodian of that minor, and you agree to be bound by this waiver on their behalf. You further agree to indemnify Rallypoint against any claims arising from the minor's participation, and if it turns out you didn't have legal authority to sign, you personally accept full responsibility.

9. Media Release

Rallypoint occasionally captures photos and video of our guests enjoying the space for marketing, social media, and promotional use. By entering the premises, you consent to being photographed or filmed and to the use of your likeness in Rallypoint's promotional materials, without additional compensation. If you'd rather not be photographed, let a staff member know and we'll respect that.

10. Governing Law

This agreement is governed by the laws of the State of North Carolina. Any disputes arising from this waiver or your visit to Rallypoint will be resolved in the state or federal courts located in Johnston County, North Carolina. If any part of this waiver is found unenforceable, the rest of it still applies in full force.

11. Electronic Signature

Agreeing to this waiver at booking, on our sign-in tablet, or via any digital method has the same legal effect as a handwritten signature. You waive any right to claim otherwise.

12. Full Agreement

By checking the agreement box at booking or signing on arrival, you confirm that you have read, understood, and voluntarily agree to everything above. You understand you are giving up substantial legal rights and you are doing so freely, without pressure or inducement.
